Terms of service.

A booking is requested when you submit the booking form and becomes a confirmed contract only when (a) you receive a confirmation email from us, and (b) your deposit (or full payment, for bookings made within 14 days of arrival) has been received. Until both conditions are met, your dates may be reassigned.

We reserve the right to decline any booking at our discretion, for example where the requested party exceeds the unit's maximum guest count, where house-rules concerns exist, or where prior conduct has caused damage to the property. In such cases any payment received is refunded in full.

Guests must be 18 or older to make a booking. The named guest on the booking is responsible for the conduct of all members of their party for the duration of the stay.

All prices are quoted in Kenya Shillings (KSh) and are VAT-inclusive at the prevailing statutory rate (currently 16%). A 50% deposit confirms the booking; the balance is due 14 days before check-in. Bookings made within 14 days of arrival require full payment up front.

By booking you agree to abide by our house rules, which cover quiet hours, pool use, smoking, day-visitor limits and care of the property and linens. The rules exist to protect the small, quiet, clean character of the retreat for all guests.

Wilful damage to the property, persistent breach of quiet hours, or unauthorised parties may result in immediate termination of the stay without refund and recovery of repair or cleaning costs from the booking deposit and, if necessary, additional billing.

The pools at Roisam Diani Retreat are not lifeguarded. Swimming is at your own risk. Children must be supervised by an accompanying adult at all times.

Where guests have engaged third-party activity providers — kitesurf instructors, dive operators, taxi or tuk-tuk drivers, tour guides, restaurants, etc. — Roisam Diani Retreat acts only as an introducer and accepts no liability for the conduct, performance, safety standards or pricing of those third parties. The contract for any third-party activity is between you and the provider.

Roisam Diani Retreat's total liability under or in connection with your booking, whether in contract, tort, breach of statutory duty or otherwise, is limited to the total amount paid by you for the stay, except where liability cannot be limited by Kenyan law (e.g. for death or personal injury caused by negligence).

Neither party is liable for failure to perform under this contract where performance is prevented by events beyond reasonable control — including but not limited to extreme weather, civil unrest, infrastructure or utility failure, government or public-health restrictions, or comparable circumstances.

Where we have to cancel a booking for one of these reasons, the force majeure provisions of our cancellation policy (section 4) apply: 100% refund or full credit toward a future stay. We are not liable for incidental travel costs such as flight changes.

The content on this site (copy, photography, layouts and code) is owned by Roisam Diani Retreat and may not be copied or republished without permission. The site is offered "as is" — we do our best to keep prices, availability and photos accurate, but reserve the right to correct errors before final booking confirmation.

These terms are governed by the laws of Kenya. Any dispute arising under or in connection with them shall be subject to the exclusive jurisdiction of the courts of Kenya.
